Apex Court: Enticement law discriminatory, thus unconstitutional
The Federal Court today repealed Section 498 of the Penal Code that criminalises men for enticing married women as it is unconstitutional.
The apex court bench led by Chief Justice Tengku Maimun Tuan Mat, in a unanimous decision, said the panel held the section as unconstitutional as it unlawfully discriminates only on the grounds of gender, which violates Article 8(2) of the Federal Constitution.
